NASHVILLE, Tenn. (WKRN) – The jury in the retrial of former Vanderbilt football player Brandon Vandenburg has started deliberations.
They were dismissed Saturday shortly before 4 p.m. to discuss Vandenburg’s fate.
He is charged with five counts of aggravated rape, two counts of aggravated sexual battery, and one count of unlawful photography.PHOTOS: Vanderbilt University rape case
Earlier Saturday, the jury listened to closing arguments.

Both sides discussed what roles Vandenburg and three of his ex-teammates played in the alleged rape of an unconscious student he had been dating.
“Mr. Vandenburg directed, he aided, he solicited, and he attempted to aid. Those are ‘ands.’ He did each and every single one, and the law only requires one,” stated prosecutor Jan Norman.
Vandenburg fought back tears during his lawyers’ closing arguments. Albert Perez told jurors his client was not criminally responsible in legal terms for directing and aiding his ex-teammates.
“He told you he didn’t understand what was happening. He told you he was intoxicated. He told you he wished he’d called someone, he wished he’d stopped it. Wishing to call someone and wishing to stop it is not criminally responsible,” said Perez.
Vandenburg did not testify in his defense. This is his second time to stand trial for the case.
He and Cory Batey were previously tried together and convicted on all charges before a judge issued a mistrial last year due to juror misconduct.
Batey has since been tried separately and was found guilty on one count of aggravated rape and three counts of aggravated sexual battery, one count of facilitation of aggravated rape and two counts of attempted aggravated rape.
Two others accused in the case, Jaborian McKenzie and Brandon Banks, have yet to go to trial.
