RALEIGH, N.C. (WNCN) – On Monday, lawyers filed a motion asking a federal judge to stop the state from enforcing the bathroom part of the law.

The ACLU of North Carolina says House Bill 2 needs to be off the books. While its lawsuit is pending in federal court, the ACLU is asking a judge to stop the state from enforcing the bathroom part of the bill.

House Bill 2 has provisions that ban the transgender community from using the bathroom of the gender that matches their identity and using the bathroom that matches their biological sex at birth.

“The matter will be adjudicated,” said Rep. Nelson Dollar, a Republican from Wake County. “There is simply no need for this additional litigation on behalf of a special interest group.”

Dollar believes blocking the enforcement of part of House Bill 2 will cause confusion with the law.

“It would create a problem because the city of Charlotte still has its ordinance in place,” Dollar said.

The ACLU views the matter differently.

“All of the anti-LGBT portions of House Bill 2 are unconstitutional, but these measures are having a particularly devastating impact,” Brook said.
