Judge recuses herself from new trial in Ohio police shooting

CINCINNATI (AP) – The judge who presided over the trial a white former University of Cincinnati police officer in the fatal shooting of a black motorist has removed herself from the case after the first trial ended with a hung jury.

Hamilton County Judge Megan Shanahan said Monday a new trial should be conducted “with a blank slate.” The case was randomly assigned to another judge, who will decide all pending matters, including the prosecutor’s plan to move the trial to another jurisdiction.

Prosecutor Joe Deters (DEE’-turs) has said he will retry Ray Tensing on murder and voluntary manslaughter charges in the July 2015 shooting of Sam DuBose, but wants a jury away from intense local attention.

Defense attorney Stewart Mathews is seeking to have Tensing acquitted after the Nov. 12 mistrial.
