COLUMBUS (WCMH) – A judge has overruled a motion by the attorneys for Brian Golsby to move his trial to another county, but the judge says he will revisit the motion during the interview for jurors.

Franklin County Judge Mark Serrott says he is denying the motion by Golsby’s attorneys to move the trial at this time, until he gets a better sense of the potential jurors’ knowledge of of the case.

Attorneys for the man accused of killing an Ohio State student filed a motion in August to move the trial to a different county.

The motion was filed by defense attorneys, along with several other motions related to evidence exclusion and jury challenges.

During the hearing on Thursday, Golsby’s attorneys argued that he was already being found guilty in the media and wouldn’t be able to receive a fair trial in Franklin County. “We think that this case above all others – it’s just insurmountable and you need to move venue without any further thought because it’s just too much,” defense attorney Kort Gatterdam told the judge.

Serrott said he hopes the public realizes that Golsby is not to be tried in the media, but only in a court room. “This is somewhat of a unique case that has received a lot of publicity so I am concerned about that,” Serrott said.

Serrott said it’s premature to consider a change of venue but said he will keep an open mind during the jury selection process. “Believe me, if we get a lot of people who we learn that they heard things band it’s tainted their view, then I’ll move the case, But I’m not inclined to move the case at this point.”

Golsby has pleaded not-guilty to charges related to the rape, kidnapping and murder of Reagan Tokes.

If convicted, Golsby could face the death penalty.
