NO PURCHASE NECESSARY TO ENTER OR WIN. The Drive Home the Gold (the “Promotion“) is sponsored by Media General Operations, Inc. d/b/a WCMH-TV and nbc4i.com (“NBC4“) and Coughlin Automotive (“Coughlin“) (together, the “Promotion Parties“). Promotion is only offered in the NBC4 viewing area within the following Ohio counties: Athens, Coshocton, Crawford, Delaware, Fairfield, Fayette, Franklin, Guernsey, Hardin, Hocking, Knox, Licking, Logan, Madison, Marion, Morrow, Perry, Pickaway, Pike, Ross and Union (the “Promotion Area“). Void outside the Promotion Area and where prohibited.
Promotion is subject to all federal, state and local laws. NBC4 shall be entitled to interpret these Official Rules as needed – including but not limited to rules regarding entries, deadlines, Finalist or winner selection, prize restrictions, and eligibility – and all of its decisions are final. By participating, you irrevocably, fully and unconditionally agree to be bound by these Official Rules and waive any right to claim ambiguity in these Official Rules and or any other Promotion-related advertising or materials.
Promotion begins on August 5, 2016 and consists of (a) ten (10) daily games (each a “Daily Game“) to select ten (10) Daily Game Finalists, (b) a “Last Chance Drawing” to select four (4) more Last Chance Finalists, for a total of fourteen (14) “Finalists“, and (c) a live Grand Prize event to select one (1) Finalist as the Grand Prize winner.
Daily Games to determine the first ten (10) Finalists will be held on week days from August 8, 2016 until August 19, 2016 (the “Game Period“). Entry deadline for each Daily Game is 5:00 p.m. Eastern Time (“ET“) on the day before the scheduled Daily Game. Each week day during the Game Period, the name of a potential Finalist will be randomly selected and announced during NBC4 Today on week days during the Game Period and that person will have fourteen (14) minutes to call a designated telephone number to qualify.
Entry deadline for Last Chance Drawing is August 21, 2016 at 11:59 p.m. ET. Last Chance Drawings to select four (4) additional potential Finalists will be held on August 22, 2016.
Live Grand Prize event (the “Grand Prize Event“) will be held on August 25, 2016 starting at approximately 6:00 a.m. ET at NBC4’s studios at 3165 Olentangy River Road, Columbus, OH 43202. Finalists must be present at Grand Prize Event to remain eligible or win a prize. NBC4’s computer is the official time-keeping device for this Promotion.
This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You are providing information to NBC4 and not to Facebook. The information you provide will only be used for administration of the Promotion and as otherwise set forth in these Official Rules. Any questions that you have about this Promotion must be directed to NBC4 and not to Facebook.
Grand Prize winner will be issued an IRS 1099 MISC tax form (or its equivalent) for the ARV of the prize awarded if required and is solely and exclusively responsible for any and all state, federal or local income taxes that may result from his or her acceptance of the Grand Prize.

ELIGIBILITY

To be eligible, each entrant must be at least eighteen (18) years old and a legal United States resident living in the Promotion Area (above).
Employees of NBC4, Media General, Inc. (“Media General“), Coughlin, any other entity directly involved in the development or administration of the Promotion, and the members of their immediate families (defined as spouses, parents, siblings, and children, and each of their respective spouses) and households, are not eligible to enter or win. The term “household” includes all persons residing together in a single residence, whether or not related.

Prizes & ODDS

Grand Prize (1): 2016 Ford Mustang V6 3.7L Automatic RWD (VIN 1FA6P8AMXG5255974) with Manufacturer’s Suggested Retail Price of $26,975, plus dealer-paid sales tax, title, thirty (30) day tag and waiver of dealer document fees. Approximate Retail Value (“ARV“): $28,964.
Runner-Up Prizes (13): $100 Pre-paid Visa card. ARV: $100.
The odds of winning a Runner-up Prize depend on the number of entries received. Odds of a Finalist winning the Grand Prize are one (1) in fourteen (14). Only the Finalists are eligible to win Grand Prize. Limit one (1) Finalist per household.

PRIZE RESTRICTIONS

Grand Prize winner will be required to accept responsibility for income tax payment at the time of Grand Prize selection. See below. Actual value of Grand Prize may vary, depending on industry fluctuations. If actual value of Grand Prize awarded is less than the ARV stated above, Grand Prize winner will not be entitled to any compensation or reimbursement for difference in value. Manufacturer, make, model, trim level, color and options of vehicle prize are subject to change. There is no warranty or guarantee, expressed or implied, relative to vehicle prize, including but not limited to quality, mechanical condition or fitness, except as may be offered by manufacturer or otherwise required by law.
No prize upgrades will be permitted by Grand Prize winner. Grand Prize winner will not be eligible for any rebates and all factory rebates (if any) will remain with or revert to Coughlin. Grand Prize winner is exclusively responsible, at his or her sole expense, for additional taxes, tag, license, registration, dealer preparation costs, insurance, maintenance and other fees associated with vehicle prize. Grand Prize winner must present a valid driver’s or operator’s license in the relevant class or category and proof of insurance in amounts sufficient under Ohio law for the relevant vehicle prize in order to, and as a condition of, claiming prize and must take delivery of vehicle prize from Coughlin Ford of Circleville, 24001 U.S. Route 23S, Circleville, Ohio 43113, or such other dealership or other location designated by Promotion Parties within fifteen (15) days after verification of eligibility. Failure to do so may result in forfeiture of the prize.

All prize details shall be at NBC4’s sole discretion. Each winner assumes sole responsibility for all expenses and incidental costs associated with the prize not explicitly outlined above, including without limitation, all federal, state and local taxes (if any), surcharges, and fees. Any person who wins prizes through any NBC4-sponsored promotions with cumulative value equal to or greater than $600 in a calendar year will receive an IRS 1099 Form.
Prizes are not redeemable for cash and may not be sold, bartered or auctioned. The right to receive any prize is not transferrable. Any prize or portion thereof not accepted by any winner is forfeited and no cash or substitute will be offered or permitted, unless required by law. Prizes may not be substituted except that NBC4 in its discretion may substitute a prize, or portion thereof, with a prize or portion of equal or greater value if it deems necessary. Any such changes will be announced.
Prizes offered are provided “as is” with no warranty or guarantee either express or implied by Promotion Parties. Prizes carry no warranty other than that offered by manufacturers. Promotion Parties have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Other restrictions apply.
Participation in the Promotion consists of two (2) steps: (a) submit an entry form, (b) watch NBC4 for a chance to qualify. Non-selected entries will be entered in the Last Chance Drawing.

TO enter

To participate, you must first complete an entry form. Entries will be accepted beginning August 5, 2016 at 7:00 p.m. ET and ending August 21, 2016 at 11:59 p.m. ET.
There are two (2) ways to enter:
Online: To enter online, visit http://digital-release.nbc4i.com and follow the instructions to complete an official entry form with all required information, which may include your name, e-mail address, phone number, age or date of birth and a security word or other “Secret Word” (the “Required Information“); or
Facebook: You must have a valid Facebook account to enter via this method. You may register a free Facebook account by visiting http://www.facebook.com. Entries via Facebook must comply with all Facebook Terms of Use, currently found at http://www.facebook.com. To enter via Facebook, visit http://www.facebook.com/nbc4columbus and follow the instructions to complete an entry form with any Required Information.

The online and Facebook entry pages above are referred to collectively as the “Promotion Pages.” These are the only methods of entry. Entries will not be accepted via U.S. mail, e-mail, or any other method.

To be eligible for a particular Daily Game, entries must be received no later than 5:00 p.m. ET on the day before the scheduled Daily Game. To be eligible for the Last Chance Drawing, entries must be received by NBC4 no later than August 21, 2016 at 11:59 p.m. ET. Proof of sending is not proof of receipt by NBC4 will not accept screen shots as proof of entry.
Non-winning entries will carry forward to subsequent drawings, if any. Regardless of method, limit one (1) entry per person or e-mail address. Additional entries received from any such person or e-mail address thereafter will be subject to disqualification. Any use of robotic, repetitive, automatic, programmed, mechanical, script, macro, or any other automated means or similar entry methods or agents (including, but not limited to, contest-entry services or multiple or different e-mail addresses, or the submission of false contact information under multiple or different e-mail addresses, identities, registrations, Facebook accounts or logins) or any other devices or artifices to enter or encourage, directly or indirectly, multiple or false entries are prohibited and suspected or detected entry method violations may void some or all entries submitted by that entrant, in NBC4’s sole discretion. No group submissions will be accepted.
Entries must be associated with a valid Facebook account or e-mail address and must include a valid e-mail address for the entrant. NBC4 is not responsible for voice or electronic communications that are undeliverable as a result of any form of call blocking of any kind or inability to leave a voice message or passive or as to e-mail, active filtering of any kind. In the event of a dispute as to the identity or eligibility of a winner based on an e-mail address or Facebook account, the entry will be deemed made by the “Authorized Account Holder” of the e-mail address or Facebook account used for entry. The Authorized Account Holder is the natural person who is assigned to the e-mail address used for entry, or associated with the Facebook account used for entry by the relevant Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the corresponding domain. In the event of a dispute as to the identity of any entrant, the potential winner agrees to furnish requested documentation confirming his/her status as the Authorized Account Holder.
Entrants who fail to provide any Required Information may be disqualified without further notification by NBC4. NBC4 is not responsible for entries that are lost, misdirected, garbled, distorted, truncated, incomplete, illegible, incorrect or late for any reason, and all such entries are void. NBC4 reserves the right in its sole discretion to disqualify any entry at any time that in its opinion does not comply with these Official Rules. Entries become the property of NBC4 and will not be returned or acknowledged.
The information that you provide in connection with the Promotion may be used by NBC4 in accordance with its Privacy Policy, which is found at http://nbc4i.com/privacy-policy, and which may be updated from time to time.

WATCH NBC4 (8/8/16 to 8/19/16)

Once you have submitted your entry form, watch NBC4 on week days from 4:26 a.m. ET until 7:00 a.m. ET starting on August 8, 2016 and ending on August 19, 2016 (the “Game Period“).
Each week day during the Game Period, the name of one (1) entrant whose entry was randomly selected will be announced during NBC4. That entrant will have fourteen (14) minutes to call the telephone number indicated and provide his/her Secret Word. Subject to verification of eligibility, if he/she calls back within the stated time period, he/she will be declared a Finalist. If not, or if that entrant is otherwise immediately determined to be ineligible for any reason, another entrant’s name will be announced and the fourteen (14) minute call back process will be repeated. If a potential Finalist is not confirmed by the end of that Daily Game, NBC4 in its sole discretion either may (a) repeat that opportunity in a subsequent Daily Game, (b) select an alternate Finalist during the Last Chance Drawing or otherwise before the Grand Prize Event, or (c) not select that Finalist at all, in which case the number of Finalists participating in the Grand Prize Event will be reduced accordingly. Only the Finalists will be entitled to participate in the Grand Prize Event.
All dates and times are subject to change or cancellation in the event of technical issues or human error affecting the broadcast of any Daily Game, or in the event of breaking news or national or local emergency or condition that is of greater public importance, in NBC4’s sole discretion, than the timely execution of the Promotion or timely broadcast of the Daily Game. If any of the foregoing result in the non-broadcast of the Daily Game during the particular broadcast time, NBC4 in its sole discretion may (a) choose to play that Daily Game at another time, (b) select an alternate Finalist during the Last Chance Drawing or otherwise before the Grand Prize Event, or (c) not select that Finalist at all, in which case the number of Finalists participating in the Grand Prize Event will be reduced accordingly.
Proof of calling is not proof of receipt by NBC4. Any use of robotic, repetitive, automatic, programmed, script, macro, or any other automated means or methods or agents to play are prohibited and may result in disqualification. No group submissions will be accepted. Each potential Finalist may be required to provide valid daytime telephone number or e-mail address. NBC4 is not responsible for voice or electronic communications that are not completed as a result of any form of call blocking of any kind or inability to leave a voice message or passive or as to e-mail, active filtering of any kind. In the event of a dispute as to the identity or eligibility of a Finalist based on a telephone number, the call will be deemed made by the “Authorized Account Holder” of the telephone number provided at the time of the call. The Authorized Account Holder is the natural person who is assigned to the telephone number by the relevant telecommunications provider.

DAILY GAME FINALIST VERIFICATION

Each potential Daily Game Finalist may be verified over the telephone and may be required to present valid photo identification, signed affidavit or declaration of eligibility, liability release, publicity release (where legal), tax forms and/or other legal documents to NBC4 within three (3) business days, or no later than 12:00 p.m. (noon) ET on August 22, 2016, whichever is earlier. NBC4 in its sole discretion may allow for transmission of verification documents via fax or e-mail.
In the event that any potential Finalist subsequently (a) fails to satisfy any eligibility or verification requirement herein, (b) is unwilling or unable (see below re “Exigent Circumstances”) to participate in the Grand Prize Event, (c) or is otherwise determined to be ineligible, NBC4 in its discretion may disqualify that individual and select an alternate Finalist as set out below.

LAST CHANCE FINALISTS & ALTERNATE FINALISTS

The Last Chance Drawing will be held on August 22, 2016, or within a reasonable time thereafter, at which time NBC4 or its designee will select four (4) names from all remaining timely and properly submitted entries. Subject to verification of eligibility, the persons whose names are so drawn will be declared the Last Chance Finalists. NBC4 then will select alternate Finalists, if any. All Last Chance Finalists and alternate Finalists are subject to all eligibility requirements and restrictions of these Official Rules. NBC4 will contact potential Last Chance Finalists and alternate Finalists in accordance with the information supplied to NBC4 on their entry forms and Last Chance Finalists and alternate Finalists may be required to present valid photo identification, signed affidavits or declarations of eligibility, liability releases, publicity releases (where legal), tax forms and/or other legal documents to NBC4.
Last Chance Finalists and alternate Finalists must respond to initial notification and provide any such requested verification materials to NBC4 no later than forty-eight (48) hours after initial notification or by 12:00 p.m. (noon) ET on August 24, 2016, whichever is earlier. NBC4 in its sole discretion may allow transmission of verification documents via fax or e-mail. In the event that any potential Last Chance Finalist or alternate Finalist (a) cannot be contacted directly by, or does not respond to, NBC4 within the relevant time period stated above, (b) fails to satisfy any eligibility or verification requirement herein, (c) is unwilling or unable to participate in the Grand Prize Event, (d) or is otherwise determined to be ineligible, NBC4 in its discretion may disqualify that individual and, time permitting, an alternate Finalist will be chosen by random drawing as soon as reasonably practicable after such disqualification.
If time permits, NBC4 will conduct up to three (3) alternate drawings for any Finalist slot. If NBC4 cannot verify a Finalist for a particular slot after three (3) alternate drawings or there is not enough time remaining prior to the Grand Prize Event to verify a Finalist for such slot, no further drawings will be held for that slot and the number of Finalists in the Grand Prize Event and corresponding Runner-up prizes awarded will be reduced accordingly.

GRAND PRIZE EVENT

The Grand Prize Event will be held on August 25, 2016 at approximately 6:00 a.m. ET at NBC4 studios at 3165 Olentangy River Road, Columbus, Ohio. NBC4 reserves the right to reschedule, postpone and/or relocate the Grand Prize Event should preemption or scheduling conflicts, breaking news or weather, inclement weather or conditions, or other circumstances necessitate such a change. Should the need arise to reschedule or relocate the Grand Prize Event, NBC4 reserves the right to amend affected requirements for the Grand Prize Event as it deems necessary, fair or otherwise appropriate under the circumstances. All Finalists must check in with an Event Representative at the Grand Prize Event no later than 6:00 a.m. ET. EXCEPT AS SET FORTH BELOW IN THE “EXIGENT CIRCUMSTANCES” PARAGRAPH, ALL FINALISTS MUST BE PRESENT TO WIN.
The Grand Prize Event will begin at approximately 6:00 a.m. ET and will continue until the Grand Prize winner has been determined. Order of participation will be the same as the order in which the Finalists were selected (Alternate Finalists will be deemed “selected” as of the date and time at which the original corresponding disqualified Finalist was selected). Finalists will be provided a number corresponding to that order and will participate in that order during the Grand Prize Event.
During the Grand Prize Event, each Finalist will be allowed to randomly select a game key (each, a “Game Key“) in the designated order above and then to attempt to start the ignition of the prize vehicle with the selected Game Key. Subject to verification of eligibility and compliance with these Official Rules, the Finalist whose Game Key successfully starts the prize vehicle will be declared the Grand Prize winner and the remaining Finalists will be declared Runner-up Prize winners.
Game Keys may only be obtained from Promotion Parties during the Grand Prize Event. Any tampering or reproduction of the Game Key, damaged or illegible Game Keys, or Game Keys that contain errors or irregularities of any kind are void and ineligible. All Game Keys submitted for validation become property of NBC4 and will not be returned. Game Keys that may break off inside the ignition or lock or turn the ignition or lock by breaking the ignition or locking mechanism are deemed not to be winning Game Keys and a randomly selected replacement Game Key may be issued at NBC4’s sole discretion (while supplies last). Winning Game Key must be verified by NBC4. No special apparatus or assistance from an outside source may be used when the attempt is made.

DISQUALIFICATION OF GRAND PRIZE WINNER

During Grand Prize Event: At the time of Grand Prize selection, the potential Grand Prize winner will be required to acknowledge and accept exclusive responsibility for any income taxes that may result from his or her acceptance of the Grand Prize. Failure to do so will result in his or her immediate disqualification and forfeiture of the Grand Prize, in which case the Game Key process will be repeated until a Grand Prize winner can be verified or no further eligible Finalists remain.
After Grand Prize Event: After the Grand Prize Event has concluded, if the potential Grand Prize winner: (a) declines to accept the Grand Prize, (b) fails to claim Grand Prize within the time period stated above, (c) fails to satisfy any other eligibility or verification requirement herein, or (d) is otherwise determined to be ineligible, NBC4 in its discretion may disqualify that individual and an alternate Grand Prize winner will be chosen by random drawing from the remaining Finalists who attended the Grand Prize Event as soon as reasonably practicable after such disqualification. Any alternate Grand Prize winner is subject to all eligibility requirements and restrictions of these Official Rules.
NBC4 will contact alternate Grand Prize winners in accordance with the information supplied to NBC4 on their entry forms or during the Grand Prize Event and alternate Grand Prize winners may be required to present additional signed affidavits or declarations of eligibility, liability releases, tax forms and/or other legal documents to NBC4. Any alternate Grand Prize winner must respond to such notification and provide any such requested verification materials to NBC4 within forty-eight (48) hours after such notification. NBC4 in its sole discretion may allow transmission of such additional verification documents via fax or e-mail. If necessary, NBC4 will conduct up to alternate drawings for Grand Prize winner until a Grand Prize winner can be verified or no Finalists who attended the Grand Prize Event remain, in which case the Grand Prize will not be awarded.
NBC4 may, in its sole discretion, post the verified winners’ names on the Promotion Pages and/or any of NBC4’s websites, including http://digital-release.nbc4i.com, and on or in any of NBC4’s social media pages or channels, and broadcast them on any of NBC4’s stations.

EXIGENT CIRCUMSTANCES

Finalists who are unable to attend the Grand Prize Event as a result of unforeseeable emergencies, sudden health or physical illness or injury, or other exigent circumstance or events beyond their reasonable control may request, prior to the start of the Grand Prize Event, that an eligible proxy (a “Proxy“) be permitted to attend the Grand Prize Event in their place. NBC4 reserves the sole and absolute discretion to review and/or grant any such requests, to approve any requested Proxy or to substitute a Proxy of NBC4’s own choosing, and to require such Finalist to furnish adequate documentation of the basis for such request before the Grand Prize Event or within five (5) days thereafter as a requirement of continued eligibility for any prize. Finalists agree to provide such requested documentation prior to and as a condition of winning or receiving any prize. Finalists agree that NBC4’s decision is final and binding in all respects and that only those Finalists who attend the Grand Prize Event or who have been permitted to attend via Proxy will be eligible for any prizes.
Any requested Proxy must be eighteen (18) years old or older, satisfy all other eligibility requirements and restrictions of these Official Rules and agree to be bound by the Official Rules. Prior to and as a condition of participating in the Grand Prize Event, such Proxy will be required to sign documents furnished by NBC4 including, without limitation, a Publicity Release, Liability Waiver, and a written acknowledgement that any prize won during the Grand Prize Event will be the sole and exclusive property of the absent Finalist on whose behalf the Proxy is acting. The absent Finalist must, however, comply with these Official Rules including, without limitation, the eligibility requirements and must, if he/she is a potential Grand Prize winner, sign and return all required documents within five (5) days of the Grand Prize Event or be disqualified and an alternate Grand Prize winner may, at NBC4’s sole discretion, be selected.

PUBLICITY RELEASE

By participating in the Grand Prize Event and/or accepting a prize, each Finalist (or his/her permitted Proxy) agrees to award NBC4 the right to publicize his or her name, photographs (including the use and appearance of his or her photograph on NBC4’s websites), likeness, biographical information, e-mail address, voice and details of winning and/or participation for purposes of this and future promotions without further compensation, except where prohibited.

LIMITATION OF LIABILITY & DISCLAIMER OF WARRANTIES

By entering and/or participating in any way in the Promotion, you agree that NBC4, Coughlin, Media General, Facebook, Inc., any other company involved in the development or administration of this Promotion, and a range of subsidiaries, agencies, affiliates, franchisees, promoters, prize suppliers, directors, officers, employees, agents and related persons (collectively, the “Released Parties“): (a) are not responsible for technical failures of any kind, including but not limited to lost, disconnected, interrupted, or unavailable network, server, or other connections, late, lost, undeliverable, damaged or stolen mail, or for any failed telephone or computer hardware or software, or for any failed, delayed, misdirected, corrupted, or garbled transmissions or errors of any kind, whether human, mechanical, or electronic, or for entries that for any reason are not properly submitted or received by NBC4 by any deadline stated above; (b) are not responsible for any incorrect or inaccurate information, whether caused by entrants or other participants, programming of Game Keys associated with or utilized in the Promotion, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Promotion or in the printing of this offer, administration of this Promotion, or in the selection or announcement of the winners or prizes; (c) are not responsible for any injury or damage to any computer, modem or other electrical device as a result of participation in this Promotion or downloading of any software or materials; (d) are not responsible for unauthorized human intervention in any part of the Promotion; (e) are not responsible for any unauthorized third party use of any entry materials; (f) are not responsible for the inability to select winners because of postal failure, equipment failure, or data storage failure; and (g) are not responsible for any printing, typographical, technical, computer, network or human error that may occur in the administration of the Promotion, the manufacture or programming of Game Keys, acceptance of entries, the selection of winners, the prizes or otherwise in any Promotion-related materials. Released Parties’ liability for a defective, erroneous or malfunctioning Game Key is limited to replacement of such Game Key with another eligible Game Key, while supplies last.
By entering and/or participating in any way in the Promotion, you agree to release and hold Released Parties harmless from any and all alleged, existing, or future actions, claims, and/or liabilities of whatever nature including, but not limited to, personal injury, bodily injury (including, without limitation, wrongful death and disability), property damage, and expense (including, without limitation, reasonable attorneys’ fees) and loss or damage of any other kind, relating to or arising from, in whole or in part, directly or indirectly, (a) your participation or inability to participate, in the Promotion, the Grand Prize Event, or any Promotion-related, Grand Prize Event-related or prize-related activity; (b) the use by Released Parties (including modification, adaptation, and reproduction) of entry materials during or after the Promotion; (c) the delivery, acceptance, possession, redemption, use, misuse, loss, or misdirection of any prize; and (d) any other claim or cause of action you may have against any Released Party.
BY entering AND/OR PARTICIPATING IN ANY WAY IN THE Promotion, you FURTHER AGREE THAT (A) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE Promotion, OR ANY PRIZE AWARDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THE Promotion AND/OR ATTENDING THE Grand Prize Event, BUT IN NO EVENT ATTORNEYS’ FEES; AND (C) UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO OBTAIN ANY AWARD FOR, AND you HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED AND ANY OTHER DAMAGES OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES.
SOME STATES DO NOT ALLOW LIMITATIONS ON THE ABILITY TO PURSUE CLASS ACTION REMEDIES, OR ON CERTAIN KINDS OF DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU IN WHOLE OR IN PART.

MISCELLANEOUS

NBC4 reserves the right to cancel, suspend or terminate this Promotion, or any part thereof, in the event that NBC4 determines, in its sole discretion, that the security, administration, fairness and/or operation of the Promotion has been corrupted or impaired by any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, or any other cause beyond NBC4’s control. In such an event, NBC4 will post notice of same at the Promotion Pages and select the winners at random from all non-suspect entries received prior to the suspension, cancellation or termination of the Promotion or in such other manner as NBC4, in its sole discretion, deems fair and appropriate under the circumstances.
NBC4 reserves the right to disqualify any individual from further participation in the Promotion (including the Grand Prize Event) if NBC4 concludes, in its sole discretion, that such person (a) has attempted to tamper with the entry process, Grand Prize Event process, or other any operation of the Promotion, (b) has repeatedly disregarded or has attempted to circumvent these Official Rules, or (c) has acted towards NBC4 or any other Promotion Party, entrant or other participant in an unfair, inequitable, deliberately annoying, threatening, disrupting or harassing manner. Tampering includes attempting to enter more than the number of times permitted herein, including through the use of any prohibited device or method. Any failure by NBC4 to enforce any of these Official Rules shall not constitute a waiver of such Official Rules.
ANY ATTEMPT BY ANY INDIVIDUAL TO DEFRAUD, TAMPER WITH, OR DELIBERATELY UNDERMINE, THE LEGITIMATE OPERATION OF THE Promotion MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND NBC4 RESERVES THE RIGHT TO PURSUE ANY AVAILABLE DAMAGES OR REMEDIES AGAINST SUCH INDIVIDUAL AND/OR REFER SUCH MATTERS TO LAW ENFORCEMENT FOR PROSECUTION TO THE FULLEST EXTENT PERMITTED BY LAW.
All activity arising out of and relating to the Promotion, including any reference to the status of any person as a “Finalist” or “winner” is subject to verification and/or auditing for compliance with the Official Rules. If NBC4 determines, in its sole discretion, that verification or auditing activity evidences non-compliance of an entry and/or entrant with the Official Rules, NBC4 reserves the right to disqualify such entry and/or entrant from the Promotion and any prize at any time. NBC4 reserves the right to conduct a background check on any or all potential winners and to disqualify any individual based on such background check if NBC4 determines in its sole discretion that awarding a prize to any such individual might reflect negatively on NBC4. Each entrant agrees to cooperate with NBC4 and its representatives in connection with any and all verification, auditing and/or background check activities.
NBC4 reserves the right to correct typographical, printing or clerical errors in any Promotion-related materials. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming, a duplication of the winning Game Key or any other error or reasons cause more than the stated number of prizes or winning Game Keys as set forth in these Official Rules to be available and/or claimed, NBC4 reserves the right to award only the stated number of prizes by a random drawing from among all legitimate, un-awarded, eligible prize claims.

DISPUTES

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants or Released Parties in connection with the Promotion, shall be governed by Ohio law, without giving effect to any choice of law rules that would cause the application of the laws of any jurisdiction other than Ohio.
By entering and/or participating in the Promotion, you expressly (a) agree that any legal proceedings arising out of or relating in any way to this Promotion or these Official Rules shall be brought only in the federal or state courts located in Franklin County, Ohio, and (b) consent to the mandatory and exclusive jurisdiction in such courts with respect to any such legal proceedings.
In the event of any discrepancy or inconsistency between any terms or conditions of these Official Rules and any disclosures or other statements contained in any other Promotion-related materials, including but not limited to the Promotion entry forms, or point of sale, television, print, mobile or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control. In the event that any provision of these Official Rules is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
