PLANO, TX (WCMH) — The sound of children playing outside is the focus of a lawsuit between two neighbors in Texas.

Kelly Counts recently put a playhouse in her backyard so her children, ages 10, 7, 4 and 2, could spend more time playing outside, she tells KTVT-TV. But now, she’s being sued by her neighbor because the children play too loudly.

“It’s unfathomable to me. I can’t imagine the sound of kids playing at any age or stage of my life and thinking that I needed to sue someone over it,” Counts said.

The lawsuit claims the noise her children make while playing outside upsets her neighbors “tranquil quality of life” and created “noise and visibility issues for them and their pets.”

Counts tells KTVT-TV that she’s now filed a counter lawsuit because the neighbors began trying to drown out the noise by playing explicit music every time the kids go outside.

A court date on both lawsuits is still pending.
